<p>These hearings are one of the first real reviews of the foundational tax code upon which the structured settlement industry is based, that being the exclusion from taxation of injuries caused as a result of personal physical injury. These hearings were originally scheduled to discuss expansions of that definition and modifications of the language, primarily to make clear the tax status of cases such as sexual abuse, wrongful imprisonment, illness caused by a hostile work environment, etc.</p>
<p>However, the issue of 468B single claimant cases is being raised as part of the hearing, prompting a scramble by the various associations and interested parties to respond to the questions raised by this request.</p>
<p>Jack Meligan discusses his perspective on the always contentious single claimant 468B trust issue as part of this podcast, as well as raising awareness of the hearings and the issues to be discussed. Regardless of where you are on the politics and implications of this, you will want to watch the outcome of these hearings as they have a substantial impact on our profession, the definitions of what is a taxable damage situation and whether there will ever be clarity on the topic of 468B trusts.</p>

<p><strong>Jack Meligan</strong> has been involved in the financial services industry since 1979, first as a Financial Analyst and then as a Registered Investment Advisor. From January 1985 to the present, Jack has specialized in the <a title="structured settlement" href="http://www.settlepro.com/">structured settlement</a> marketplace, with special emphasis on comparative analysis of structured annuities vs. alternative investment options. He is the author of several articles regarding structured settlements, including one dealing with the conflict of interest inherent in the current process.</p>
<p>In November of 1995, the National Structured Settlement Trade Association (NSSTA), in conjunction with the University of Notre Dame, conferred upon Mr. Meligan the designation of Certified Structured Settlement Consultant (CSSC), in recognition of his successful completion of more than 60 hours of course study culminating in a comprehensive examination covering such topics as insurance casualty claims practice, state and federal laws pertaining to tort settlements, medical reversionary and special needs trusts, macroeconomics, the art of negotiation and business ethics. Jack is one of only ninety-seven industry professionals from across the country to have earned this designation.</p>
<p>In July 1996, Mr. Meligan was accepted into membership of the American College of Forensic Examiners (ACFE). The ACFE recognizes experience and education of individuals engaged in forensic examinations covering multidisciplinary training in medical, scientific and investigative sciences. The ACFE is comprised of a collective group of professionals actively engaged in the field of forensic examination and consultation.</p>
<p>Jack travels extensively across the U.S., and resides in Lake Oswego, Oregon, with his wife Kathleen and their two daughters.</p>
